Ice cream makers Ben & Jerry’s filed a lawsuit against porn studio Caballero “for selling hard-core DVDs that spoof the famed ice-cream company’s labels and flavors”. The suit claims Caballero’s DVD releases represent “blatant and outrageous copying and misappropriation of the Ben & Jerry’s intellectual property”.
We posted a gallery of Caballero’s XXX compilations spoofing Ben & Jerry’s ice cream flavors a few months back.
And Gay Porn Parody posted Caballero’s “Americone Cream” DVD around the same time.
Caballero obviously intended the similarities. The only question is whether this Wacky Packages-style imitation of Ben & Jerry’s packaging constitutes legally protected parody or illegal trademark infringement.
